Terms of Service Agreement

Rental Rules 

CHECK-IN TIME is AFTER 4 P.M. EST AND CHECKOUT are 11 A.M. EST. NO Early Check-in or late checkout. 
THIS IS A NON-SMOKING HOUSE AND PROPERTY.
PETS are permitted on the property and in the house only with prior approval. $10/day per pet fee applies unless the owner decides to change to a one-time fee. There may also be an additional damage deposit for pets. All pets must be leashed at all times. Pet owners are responsible for cleaning up any/all pet refuse. Pets are not allowed on furniture at any time. Any evidence of pets on furniture may incur extra cleaning fees. All pets must be up-to-date on rabies vaccinations and all other vaccinations. Heartworm prevention is highly recommended. All pets are to be treated with Advantage or similar topical flea and tick repellent three (3) days prior to arrival. Fleas and ticks are very rampant in this area and can cause harmful/fatal illnesses to humans and pets. All items above are the sole responsibility of the pet owner. The homeowners assume no responsibility for illness or injury that humans or pets may incur while on the premises.  
DAMAGE/RESERVATION DEPOSIT - A reservation deposit of $250 is required on nightly rentals, but long-term rentals can be higher and are determined by the homeowner. If the property is rented by the month a higher reservation/damage deposit will be required. This must be received within five (5) days of booking the reservation. In the rare event that a deposit is not received before checking in to the rental, the homeowner has the right to charge the renter's credit card for damages within (14) days of departure. The deposit automatically converts to a security/damage deposit upon arrival. The deposit is NOT applied toward rent; however, it is fully refundable within (14) days of departure, provided the following provisions are met.
•No damage is done to the unit or its contents, beyond normal wear and tear. 
•The property and all furnishings are in good order
•Appliances used only for their intended uses
•No charges are incurred due to contraband, pets, or collection of rent or services rendered during the stay. 
•All debris, rubbish, and discards are placed in a dumpster, and soiled dishes are cleaned. 
•All keys are left on the kitchen table and the unit is left locked. 
•All charges accrued during the stay are paid prior to departure. 
•No linens are lost or damaged. 
•NO early check-in or late checkout. 
•The renter is not evicted by the owner (or representative of the owner), the local law enforcement. 
PAYMENT – An advance payment equal to 50% of the rental rate is required 60 days before arrival. The advance payment will be applied toward the rent. Please make payments via PayPal, money order, or personal checks payable to Nell’s Farm House. The advance payment is not a damage deposit. The BALANCE OF RENT is due fourteen (14) days before your arrival date.  Long-term rentals will pay all funds due at the time of booking. We do not accept payment for by the month-long for-long term rentals. There is no refund for leaving early on a long term rental. 
CANCELLATIONS - A sixty (60) day notice is required for cancellation. Cancellations that are made more than sixty (60) days prior to the arrival date will incur no penalty. Cancellations or changes that result in a shortened stay, that are made within 60 days of the arrival date, forfeit the full advance payment and reservation deposit. Cancellation or early departure does not warrant any refund of rent.  Long-term renters need to pay upfront for the full stay. If the stay is extended then failure to do so voids the rental agreement and renters must leave the property. There will be no refunds of rental payments or deposits.
Option B) CANCELLATIONS –Cancellations that are made more than sixty (60) days prior to the arrival date are subject to a 5% cancellation fee or $50, whichever is greater. Cancellations or changes that result in a shortened stay, that are made within 60 days of the arrival date, forfeit the full advance payment and reservation deposit. Cancellation or early departure does not warrant any refund of rent. 
MONTHLY RESERVATION CANCELLATIONS – Monthly renters must cancel one hundred twenty (120) days prior to check-in. Monthly renters who make a change that results in a shortened stay must be made at least ninety (90) days prior to check-in. There is no refund after check-in for shortened stays.
MAXIMUM OCCUPANCY – The maximum number of guests is limited to six (6) persons. An additional charge per person per night for guests in addition to two (2) will be assessed.  People other than those in the Guest party set forth above may not stay overnight on the property without approval by the homeowner. All adult parties must be listed with owners. People other than the paid guest cannot use the facilities such as water, washer, dryer, stove, utensils, etc.
MINIMUM STAY – This property requires a three (3) night minimum stay. Longer minimum stays may be required during holiday periods. If a rental is taken for less than two days, the guest will be charged the two-night rate. 
FEES – Rates include a one-time linen & towel setup. Amenity fees are included in the rental rate. Cleaning fees, damage deposits, and advance deposits for long-term renters may apply. 
NO DAILY HOUSEKEEPING SERVICE – While linens and bath towels are included in the unit, daily maid service is not included in the rental rate. However, it is available at an additional rate. An extended renter is responsible for keeping the home clean. We do not permit bath towels or linens to be taken from the unit. A cleaning fee will be added to the rental rate.
USE OF PROPERTY - No one can use the house outside or its facilities other than paid renters without written permission from the owner. This includes amenities such as the kitchen, washer/dryer, internet, phone, etc. All parties or gatherings are not allowed except with the permission of the owners. A request must be made in writing and approved by the homeowners. If people other than the number in which the property is reserved stay overnight, a fee will be charged. If any kind of approved party/event is held an additional charge can be added in accordance with the size of the party. If there are people gathering at the house or using the house without prior written permission then all parties can be removed from the property and rental payment will not be refunded.  No Smoking in the house. Failure to use this property in the manner it is booked can terminate the rental agreement and money will not be returned. 
RATE CHANGES – Rates are subject to change without notice and can vary from printed rates. Long-term rentals are charged by the month. However, in the event that a full month is not booked, the owner can charge an average daily rate. 
FALSIFIED RESERVATIONS – Any reservation obtained under false pretense will be subject to forfeiture of advance payment, deposit, and/or rental money, and the party will not be permitted to check-in. A valid driver’s license or picture ID will be required at check-in to the property. Photo ID and a signed contract is required of all paying parties. 
WRITTEN EXCEPTIONS – Any exceptions to the above-mentioned policies must be approved in writing in advance. 
PARKING – Parking is limited to two (2) vehicles. Vehicles are to be parked in designated parking areas only. Parking on the road is not permitted. Any illegally parked cars are subject to towing; applicable fines/towing fees are the sole responsibility of the vehicle owner.
FIREPLACE – The fireplace is for looks only. Please do not use the fireplace.
WATER AND SEPTIC – This house is on a well and septic system. The septic system is very effective; however, it will clog up if improper material is flushed. DO NOT FLUSH anything other than toilet paper. No feminine products should be flushed at any time. If it is found that feminine products have been flushed and clogged the septic system, you could be charged damages of up to two hundred dollars ($200).
Farm Equipment and Animal: This property is located on a working farm. The homeowners assume no responsibility for illness or injury that humans or pets may incur while on the premises. No renter is allowed inside of the pasture fences. 
ACCESS: The guest shall allow the Homeowner access to the property for purposes of repair and inspection. The homeowner shall exercise this right of access in a reasonable manner. 
CHECK-IN - A credit card must be presented at check-in for incidentals by the responsible party. All adult parties will sign a rules agreement.
The Homeowners are not responsible for the loss of personal belongings or valuables of the guest. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise.
You hereby agree that any legal action brought in connection with this website or your relationship with your rental must be brought in Cleveland County, North Carolina
